SITA will most likely be struck down under the taxing and spending clause. Taxing and spending clause is the clause in Article 1, section 8, clause 1 of the US constitution grants the federal government the power of taxation. It authorizes the congress to collect taxes for the purposes of paying debts of the state and provide the common defense and welfare of the united state.
